Participation Waiver, Assumption of Risk and Release of Liability

IT AFFECTS YOUR LEGAL RIGHTS AND THE LEGAL RIGHTS OF YOUR CHILD. This agreement is between Fastpitch Authority ("we", "us") and the parent or legal guardian signing below ("you"), on behalf of the athlete named in the registration ("the Athlete"). ## 1. What the Athlete is taking part in Fastpitch Authority Prospect Days are in-person events at which our staff measure athletic performance. Activities include, without limitation: throwing, hitting off a tee and live, fielding, base running, timed sprinting, agility testing, medicine-ball throws, jumping, warm-up and stretching, and moving about an outdoor or indoor athletic facility. ## 2. Assumption of risk Softball and athletic testing involve inherent risks of injury that cannot be eliminated regardless of care taken. Those risks include, without limitation: being struck by a batted, thrown or pitched ball or by a bat; collisions with other participants, staff, equipment or fixed objects; slips, trips and falls; sprains, strains, fractures and dislocations; muscle, ligament and tendon injury including injury arising from maximal effort; concussion and other head, neck and spinal injury; dental and facial injury; heat illness, dehydration and sunburn; exposure to weather; aggravation of a pre-existing condition; and in rare cases catastrophic injury, permanent disability or death. You acknowledge that you understand these risks, that you have had the opportunity to ask questions about them, and that you knowingly and voluntarily accept them on behalf of yourself and the Athlete. ## 3. Fitness to participate You confirm that the Athlete is physically fit to take part, is not currently injured in a way that participation would worsen, and is not subject to any medical restriction on athletic activity. You agree to withdraw the Athlete from any activity if that ceases to be true, and to tell our staff promptly. You confirm that you have disclosed in the Medical Authorization any condition, allergy, medication or injury relevant to her safe participation. ## 4. Release To the fullest extent permitted by law, you release and agree not to sue Fastpitch Authority, its owners, officers, employees, contractors, volunteers, and the owners and operators of any facility used for the event, from any claim for injury, illness, loss or damage arising out of participation in the event, including any claim arising from ordinary negligence. This release does not apply to, and you do not release, any claim arising from gross negligence, recklessness, or wilful or intentional misconduct, or any claim that cannot be released under applicable law. ## 5. Indemnity You agree to indemnify and hold us harmless against any claim brought by or on behalf of the Athlete arising out of participation in the event, except to the extent that claim arises from our gross negligence, recklessness or wilful misconduct. Nothing in this paragraph requires you to indemnify us against any liability that cannot lawfully be indemnified. ## 6. Emergency care You authorise our staff to arrange first aid and, where they judge it necessary, emergency medical treatment or transport for the Athlete, and to act on our reasonable judgement if you cannot be reached. The Medical Authorization sets this out in full. You accept responsibility for the cost of any medical care provided. ## 7. Conduct and removal We may remove the Athlete, you, or anyone accompanying you from an event without refund for conduct that is unsafe, abusive, or disruptive to others. Instructions given by our staff for safety reasons must be followed. ## 8. Data and results Measurements taken at the event are recorded and published on the Athlete's profile as described in the Fastpitch Authority Privacy Policy. Photography and video are governed by the Media Release, which is optional and which you may decline without affecting participation. ## 9. Insurance We do not provide medical or accident insurance for participants. You are responsible for the Athlete's own health insurance coverage. ## 10. Severability If any provision of this agreement is held unenforceable, that provision is to be enforced to the greatest extent permitted by law and the remaining provisions remain in full force. In particular, if a court holds that a parent or guardian may not release a minor's own claims, that holding does not affect the release of your own claims or the assumption of risk set out above. ## 11. Governing law This agreement is governed by the laws of the State of Alabama, without regard to its conflict of law provisions. Any action arising out of it shall be brought exclusively in the state or federal courts located in Winston County, Alabama, and you consent to the jurisdiction of those courts. ## 12. Acknowledgement By typing your name and submitting this form you confirm that: - You are the parent or legal guardian of the Athlete and have authority to sign for her; - You have read and understood this agreement in full; - You are signing freely and without inducement; and - You intend your typed name to be your legal signature, and agree that an electronic signature has the same effect as a handwritten one.
