These Terms govern your use of Fastpitch Authority — the website, athlete profiles, verified metrics, rankings, and in-person events.
Fastpitch Authority and Flex Scorebook share one login and one database. The Flex Scorebook Terms of Service govern scorekeeping and team pages; these Terms govern profiles, metrics, rankings, and events. Where you use both, both apply.
By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.
## 1. What Fastpitch Authority is
We publish athlete profiles, performance statistics drawn from scored games, verified physical measurements taken at our events, and rankings computed from those game records.
We are a measurement and publishing service. We are not a recruiting agency, we do not represent athletes, and we do not promise or influence any college outcome. Nothing here is a guarantee of exposure, interest, or a scholarship.
## 2. Who may use it
You must be 18 or over to hold an account, unless you are an athlete aged 13 to 17 using an account permitted under the Children's Privacy Notice.
A child under 13 may not create or control an account. A parent or legal guardian acts for her.
If you create an account on behalf of an athlete, you confirm you are her parent or legal guardian, or that you are a coach or team official with a legitimate role on her team.
One person, one account. Do not share credentials.
## 3. Your account
You are responsible for what happens under your account and for keeping your password private. Tell us immediately at support@fastpitchauthority.com if you think someone else has access.
Give us accurate information. An account created with a false identity, or a claim on a child you are not responsible for, may be suspended without notice.
## 4. Claiming an athlete
A coach may add a player to a roster before any parent is involved. Such an entry is never named publicly.
A guardian claims an athlete through a claim link and confirms her relationship. Claiming does not publish anything; it gives the guardian control over what may be published.
**Claiming a child you are not the parent or legal guardian of is a serious misuse of this service.** We will remove such a claim, may suspend the account, and may report it.
A coach who claims a player in error may undo it, which revokes the consent that claim created.
## 5. Content you provide
You keep ownership of photographs, video, biographies, and other material you upload.
You grant us a licence to store, display, and distribute that material for the purpose of operating the service — showing her profile, her card, and her team page. That licence ends when you delete the material or the profile.
Publicity use — promotion, features, advertising — is governed separately by the Media Release, which is optional.
You confirm you have the right to upload what you upload, and that any identifiable person in it has consented. Do not upload a photograph of somebody else's child.
## 6. Statistics, rankings, and accuracy
Statistics come from games scored by coaches. We publish what was recorded. We do not independently verify every entry, and a coach can make a mistake.
If you believe a number is wrong, email us with the athlete, the team, and the game. A scoring error is corrected in the game record and the ranking follows at the next weekly run.
**We do not adjust a ranking by hand.** A ranking that can be edited on request is not computed from anything. The Rankings Methodology sets out the calculation in full.
**Rank position is not for sale.** Subscription status and event attendance are excluded from every input. Buying a subscription reveals names on a board; it does not move anyone.
## 7. Verified metrics
Measurements taken at a Prospect Day are recorded with the device used, its serial number, its calibration date, the operator, the method, and the timestamp. That chain of custody is published with the measurement.
A verified metric is a record of one measurement, on one day, under the conditions recorded. It is not a prediction and not a grade.
Only measurements taken by our staff on our equipment carry the verified mark. Nothing self-reported ever will.
## 8. What you may not do
- Claim an athlete you are not responsible for
- Enter false statistics, or score games that did not happen
- Attempt to manipulate a ranking by any means
- Scrape, bulk-download, or systematically copy profiles, statistics, or rankings
- Use the service to contact, solicit, or attempt to identify a child you have no relationship with
- Resell or redistribute our data
- Attempt to access another account, or any part of the system you are not authorised to reach
- Probe, scan, or test the security of the service without our written permission
- Upload anything unlawful, abusive, or infringing
We may suspend or terminate an account for any of the above, without refund. See section 12.
## 9. Public information
Parts of this service are a public directory. The Privacy Policy sets out precisely what is public and what never is.
Two rules are worth restating here: an unclaimed athlete is never named publicly, and the venue and start time of a game are never published.
## 10. Subscriptions and payment
Subscriptions are annual, and are governed by the Subscription Terms, which form part of these Terms.
In short: annual billing only, no trials, no discounts other than a published promotion, and all sales are final. Prospect Day tickets are a separate one-time purchase.
## 11. Events
Attendance at a Prospect Day requires a signed waiver and the other event documents. Those must be completed before payment, and that requirement is enforced by our systems rather than left to the check-in desk.
Event Terms govern conduct, cancellation, and weather. The Media Release is optional and declining it does not affect participation.
**Attending an event cannot affect a ranking.**
## 12. Suspension and termination
You may close your account at any time by emailing us.
We may suspend or terminate an account that breaches these Terms, that we reasonably believe is being used to harm a child, or where required by law. Where the breach is serious — a false guardian claim, an attempt to manipulate rankings, misuse involving a child — we may act immediately and without refund.
On termination, the Privacy Policy governs what is deleted and what is retained.
## 13. Availability
We try to keep the service running and monitor it continuously. We do not promise uninterrupted availability. Scorekeeping works offline by design, so a game in progress is not lost if the service or your signal goes down.
## 14. Changes to the service and to these Terms
We may change the service. Where a change materially reduces something you have paid for, we will tell you.
We may update these Terms. The effective date at the top changes, and we will notify account holders by email of a material change. Continuing to use the service after that means you accept the change. If you do not, close your account.
## 15. Disclaimers
The service is provided "as is". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that statistics are error-free, that rankings reflect any particular judgement of ability, or that use of the service will produce any recruiting outcome.
## 16. Limitation of liability
To the fullest extent permitted by law, Fastpitch Authority is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunity, arising from your use of the service.
Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
Nothing in these Terms limits liability that cannot lawfully be limited, and nothing here limits liability arising from an in-person event, which is governed by the Waiver and the Event Terms.
## 17. Indemnity
You agree to indemnify Fastpitch Authority against claims arising from your breach of these Terms, from content you uploaded, or from a claim you made on an athlete you were not entitled to claim.
## 18. Governing law and venue
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles. Any dispute lies in the state or federal courts serving Winston County, Alabama, and you consent to that venue.
## 19. Miscellaneous
If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a sale of the business.
These Terms, together with the Privacy Policy, Children's Privacy Notice, Subscription Terms, and — where you attend an event — the Waiver, Medical Authorization, Media Release and Event Terms, are the entire agreement between us.
